CV Writing Terms and Conditions
Please read the terms and conditions before placing an order. By using the site or our services, you agree to and accept the Terms and Conditions, as well as the collection, retention, and use of your personally identifiable information, in accordance with the Privacy Policy, as revised from time to time. We reserve the right to change these terms, conditions, and prices at any time and without prior notice. *Please note that we are currently only servicing clients from South Africa.
Definitions
"Website" - www.winaid.co.za
"We/Us" - Refers to Winaid or any of its employees.
"Management/The Management" - Denotes a member of the Winaid Senior Management Team.
"Customer/Client/You/Your" - Represents an individual who consents to place an order for any of the services listed on the website - www.winaid.co.za.
“CV/Services” - Encompasses the writing, editing, and formatting of a CV, Cover Letter, Application Form, Personal Statement, Interview Questions, or any other documentation commissioned by the client.
“CV” - Stands for Curriculum vitae.
"Protection of Personal Information Act" - Holds the meaning as given in South Africa (SA). It refers to the Protection of Personal Information Act 4 of 2013 (POPIA), which provides regulations and guidelines surrounding the collection and processing of personal information.
"Schedule" - Pertains to the need for efficiency, ensuring that the work developed or designed is carried out at the scheduled time.
"Design and Development" - Refers to the technical specifications of the CV or CV writing that the CV writer will produce for the client.
"Business Day" - Denotes any weekday (Monday through Friday) that is not a public holiday in South Africa.
"Business Hours" - Represents the timeframe between 09:00 and 17:00 South African time on a business day.
"Price/Total Payment" - Signifies the amount as per the details in your quotation or invoice.
"Design Elements" - Encompasses the visual appearance of the CV, including page layouts, artwork, photographs, logos, graphics, and text comprised in the CV, excluding certain elements.
"CV Services" - Encompasses the writing, editing, and formatting of a CV, cover letter, application form, personal statement, interview questions, or any other documentation commissioned by the client.
"Force Majeure Event" - Refers to an event or a series of related events outside the reasonable control of the affected party, including failures or problems with the internet, power failures, industrial disputes, changes to the law, disasters, explosions, fires, floods, riots, terrorist attacks, and wars.
"Intellectual Property Rights" - Denotes all intellectual property rights, registered or unregistered, globally, including copyright, database rights, confidential information, trade secrets, know-how, business names, trade names, trademarks, service marks, passing off rights, unfair competition rights, patents, petty patents, and trademarks.
"Third Party Works" - Refers to the elements and works, excluding client works, whose intellectual property rights are either fully or partially controlled by a third party.
"Agreement / Term" - Signifies the term of these terms and conditions to be accepted by the client.
Language
All documents are produced in English.
Communicating with Winaid
● Due to the complexity and nature of our business, as well as the volume of CVs we manage, we prefer virtual communication via email over phone calls, conference calls, or in-person meetings. This electronic mode of communication facilitates a better understanding of details and recommendations, reducing the likelihood of misunderstandings.
● The primary advantage of electronic communication is our ability to collaborate virtually with clients across South Africa, regardless of their location. This approach has not only improved the efficiency of our team but has also contributed to keeping the costs of our CV services affordable for clients. There are no additional travel expenses or hourly consultation charges.
● Due to the high incidence of emails ending up in clients' gmail.com spam email folders, Winaid does make use of gmail.com, including our official @winaid.co.za email addresses, to prevent official emails from Winaid from ending up in your spam folder. If you did not receive an email sent to you, please check your spam folder just in case the email got delivered there instead of your inbox. If so, select the email and click "Not Spam," which will allow future emails from Winaid to get through.
Winaid’s Liability
● Winaid is not liable for the client's inability to secure a position, occupation, promotion, or achieve any other career objective. The outcome of the client's career pursuits is not guaranteed by Winaid.
● Winaid is not responsible for any indirect or consequential losses experienced by the client as a result of using our services.
● Winaid does not provide warranties or representations that are not expressly stated in the Terms and Conditions. Any assurances or guarantees beyond what is explicitly outlined in the Terms and Conditions are not the responsibility of Winaid.
Services
Winaid will:
● Provide CV writing services.
● Our CV services encompass the following elements:

▪ Custom layout design and professional written format.
▪ Industry-targeted keywords for optimum system recognition.
▪ One targeted cover letter.
▪ General Cover Letter: Responding to the Advertised Position.

▪ After the interview: Thank-You letter
▪ Job Offer Acceptance Letter
▪ Formal Resignation Letter
▪ Two revisions
▪ 48-Hour First Drafts
▪ 3 working days delivery
▪ Now, you have the option to include a complimentary QR code on your CV! By scanning this QR code, the hiring manager gains instant access to your contact details, LinkedIn URL, personal website, online portfolio, published articles, and any other content you wish to showcase.
Payment Terms
● In order to ensure a seamless and efficient process for both parties, we kindly request full payment before commencing work on your resume. This policy is in place to maintain the quality and prompt delivery of our services.
● By receiving payment upfront, we can allocate dedicated resources and attention to your project immediately, ensuring a timely and thorough review of your CV. This approach allows us to prioritise your needs and deliver the best possible results within the agreed-upon timeframe.
● Upon the relevant invoicing date, Winaid will issue an invoice to the client detailing payment and charges.
● Full payment for all invoices is required. The client is expected to make the payment to Winaid within one business day of the invoice issue date, or as specified on the invoice if later.
● Winaid considers the receipt of full payment from the client as an acknowledgment that the client accepts the invoice and our services in accordance with our terms and conditions and privacy policy.
● Payments can be made via direct bank deposit, cash, or EFT within South Africa, with the reference being your Name and Surname.
● Use of a direct bank deposit or EFT to pay Winaid for services is strictly at your own risk.
● Banking details will be provided at the bottom of your attached invoice.
● Winaid reserves the right to withhold the commencement of work on your order or assignment until full payment for the required services is received.
● We understand the importance of your CV in shaping your professional image, and we are committed to providing you with a service that exceeds your expectations. If you have any questions or concerns regarding this payment policy, please feel free to reach out. We are here to assist you throughout the process.
If a client is dissatisfied with their CV package and services
● The client should inform Winaid within one business day of receiving the CV package, providing a detailed explanation of why the cover letter and CV fell short of expectations.
● Winaid requires this information to address any issues promptly. While making every effort to avoid drafting and design errors, if any arise, corrections will be made free of charge within one business day after delivery. This guarantee covers instances where the work is found to be defective upon delivery.
Payment Not Honoured
The following terms shall apply to your order if, for any reason, your bank or you do not honour your payment:
● Winaid will accept, as per our understanding, that you, the client, do not intend to use our services if payment is not made by you within one working day from the date we sent you an email with your order confirmation and invoice. In this case, the order will be deemed cancelled and closed.
● Both parties will not need to communicate further.
Use of PayPal
● Under no circumstances do we accept payments by PayPal. We take no responsibility for any money lost or costs incurred as a result of attempting to make payment to Winaid by PayPal.
● Within South Africa, payments can only be made via EFT or direct bank deposits.
Turnaround Times
● The first CV and cover letter draft normally takes 2 working days to complete, within the specified time frame upon the acceptance of the invoice and order, as outlined in our Terms and Conditions.
● Any delay in the provision of services resulting from the client's actions or omissions will be the client's responsibility. In such cases, the delivery date will be extended to accommodate the delay.
● Winaid reserves the right to charge the client for reasonable costs and expenses incurred due to the delay.
● We provide two rounds of revisions for the CV (wording, design, etc.), with one working day allotted for each revision.
● If unforeseen circumstances arise, indicating that the preparation of your documents may take longer than two working days, Winaid will notify you promptly.
● Working days are considered from Monday through Friday, excluding public holidays in South Africa, and our office hours are from 9 a.m. to 5 p.m.
Cancellation of the Order by the Client
● We understand that clients may face unforeseen circumstances, and to address this, we offer a cancellation policy that considers our administration costs, consultant's schedule, and research work.
● Either party has the right to cancel the order in writing within 3 hours of placing the order, provided that Winaid has not initiated work on the client's CV package.
● If the client commits a breach or violation of any provision in these terms and conditions and the breach is remediable but the client fails to remedy it within one day of receiving a written notice requiring resolution.
Please ensure you use a compatible Microsoft Word version to view your draft CV and cover letter documents
● Note that older Microsoft Word versions may not fully support all formatting features on various devices.
● Some formatting features may not display correctly when using outdated Microsoft Word versions.
● Editing Microsoft Word files on your device can lead to compatibility issues, especially when sending them to recruiters.
● We recommend viewing and editing your Microsoft Word draft CV on a PC or laptop with a compatible version installed, preferably Microsoft Word 2016 or later.
● When updating your draft CV and cover letter documents, follow these steps
▪ Update the content in the MS Word versions of your CV and cover letter.
▪ Save the MS Word documents with the changes.
▪ Convert the updated MS Word documents to PDF format.
▪ When applying for job interviews, use the PDF versions of your CV and cover letter, even if the hiring organisation requests the MS Word version.
▪ Note: Using the PDF version helps protect your documents from being duplicated or modified without your knowledge, providing an extra layer of security for your application materials.
When you receive your drafted CV and cover letter
● Upon receipt of your drafted CV and cover letter, you are required to confirm receipt by email.
● Notify Winaid of any changes needed within one working day.
● Two revisions are allowed, with one working day for each revision.
● Should you wish to change any details after acceptance of the final draft, additional charges may apply.
If, for any reason, upon receipt of your drafted CV and cover letter, you have not confirmed receipt of your your drafted CV and cover letter by email, then the following conditions will apply:
● If no receipt confirmation or amendments are received from you within one working day from the date Winaid emailed your drafted CV and Cover Letter for your review and approval, then Winaid will accept, as per our understanding, that you are satisfied with your drafted CV and Cover Letter "as is" and the order will be deemed complete and closed.
● No further communication will be required from both parties.
Additional charges may apply under the following circumstances
● After two formal revisions, if the client requires additional versions of the CV or cover letter, a new invoice will be generated.
● If the client requests extra versions of the CV or cover letter after completing two official revisions and the approval process.
● If the client decides to target the CV for a different role or employment sector after it has already been completed based on the original CV, additional charges will be incurred.
Winaid provides the following information regarding electronic copies of documents
● While efforts are made to check electronic documentation for viruses and bugs before transmission via email, the client is responsible for ensuring their computer or device is adequately protected.
● Winaid cannot be held responsible for any computer, device, or Microsoft Word version compatibility issues experienced by the client with their individual PC, laptop, device, or Microsoft Word version.
Winaid outlines the following regarding the disclosure of confidential information
● Winaid will make reasonable efforts to prevent the disclosure of confidential information to unauthorized individuals.
● Confidential information will only be disclosed to persons employed or engaged by Winaid or those authorised by the client.
● All client-submitted information will be handled in accordance with the Privacy Policy and the "In the event the client does not honour payment policy.
Delegation
● Winaid reserves the right to delegate its rights and obligations to third parties for the purpose of providing services to clients.
Third Party Works
● The client will be responsible for any license fees associated with third-party works, in addition to the prices indicated in the schedule, unless otherwise agreed upon by the parties.
Unlawful Content
● The client is responsible for ensuring that the provided information does not violate any applicable laws, regulations, or third-party rights ("unlawful content").
● The client agrees not to use the site to violate, plagiarise, or infringe upon the rights of any third party, including copyright, trademark, privacy, or other personal or proprietary rights, or submit or publish libellous or otherwise unlawful material.
● The client will indemnify and hold Winaid harmless against all damages, losses, and expenses (including legal expenses) arising from any claim that the client's works contain unlawful content or any legal proceedings related to such a claim.
Intellectual Property Rights
● Copyright in design elements, documentation, and similar materials remains with Winaid, along with other intellectual and industrial property rights in the ordered CV package, design elements, documentation, etc.
● Winaid retains ownership of patents, copyrights, trademarks, trade names, trade secrets, and other proprietary rights related to pre-existing technology, as well as any updates, modifications, or extensions developed.
● Exclusive rights to alter, modify, translate, develop, improve, and transfer project results, design elements, documentation, etc., solely belong to Winaid.
● The terms and conditions do not grant or imply any rights under the intellectual and/or industrial property rights of either party concerning sensitive information.
● The client is granted a non-exclusive, non-transferable worldwide licence to use the CV package solely for its own needs, without the right to sublicence, market, sell, or transfer the licence rights. This licence is valid for the duration of relevant intellectual property rights in the respective countries.
Warranties
● The client guarantees Winaid:
▪ Ownership of all licences, certifications, qualifications, and intellectual property rights, along with obtaining necessary consents and adhering to the terms of the agreement.
▪ Winaid provides the following warranty to the client:
▪ Possession of legal rights and authority to enter into and fulfil the terms of the agreement.
▪ Commitment to exercising reasonable care and skill in executing its obligations under the agreement.
Limitations and Exclusions of Liability
● Nothing in these terms and conditions is intended to:
▪ Limit or exclude a party's liability for fraud or fraudulent misrepresentation.
▪ Restrict a party's liability in any manner not allowed by applicable law.
▪ Exclude any liability of a party that may not be excluded under applicable law.
Complaints
● If you need to file a complaint about any aspect of our services, please submit your complaint in writing to: admin@winaid.co.za.
● We strive to respond to all correspondence, including complaints, within a maximum of 48 hours from receipt. All complaints must be made in writing.
● If a complaint remains unresolved to a client's satisfaction, we welcome arbitration from a respected and mutually agreed-upon independent third party, with all costs to be covered by the customer.
Winaid' Obligations to the Client
● Winaid agrees to provide services to the client with reasonable skill and care and in accordance with the terms and conditions stated above.
The client's obligations when using Winaid
● In consideration of the provision of the services, the client agrees:
▪ To cooperate with Winaid by providing the information requested.
▪ To follow the reasonable instructions of Winaid relating to the service the client has ordered.
▪ Once the client is completely satisfied with the CV package and our services as per our Terms and Conditions and Privacy Policy, the client needs to pay for our services thanks to our Order-Review-Pay and no-surprise pricing policy!
Client Obligations When Submitting Information to Winaid
● The client guarantees that any information they provide to Winaid is accurate and non-defamatory, does not violate the copyright, trademark, or intellectual property rights of others, and won't impact Winaid in any way.
● Winaid is not liable for any criminal proceedings that arise as a result of false or misleading information in the client's CV or any other documents prepared by Winaid.
Indemnity
● By using Winaid, the client agrees to indemnify and hold harmless Winaid from any losses, liabilities, and expenses (including attorney fees) arising from the use of services provided through the website, any printed materials created by Winaid, or any verbal advice or direction given by a Winaid employee.
● This indemnity includes any violations of the terms and conditions, as well as the uploading, downloading, or reproduction of materials from this site, websites operated by third parties, or other online services.
Binding Nature
● To use any of our services or submit personally identifiable information, the client must accept and be bound by our terms and conditions and privacy policy.
● The client also agrees that Winaid may, in its sole discretion, disclose information about them in the situations and to the extent described in our privacy policy.
